Mom Suing New York City For $900 Trillion For Placing Children In Foster Home

A Staten Island mother is suing [New York] city for a staggering $900 trillion for allegedly wrongfully placing her two sons in foster care and claiming she was mentally unstable.

46-year old Fausat Ogunbayo, who is representing herself, says the Administration for Children's Services's decision to place her children in foster care infringed upon her civil rights and ultimately inflicted "over three years of terror, horror, grievous harm, time lost, substantial economic hardship and injuries."

The children, then 12 and 10-years old, have been out of their mother's custody since June 2008.

In court papers, the ACS references several peculiar incidents where Ogunbayo sought out medical treatment because she believed her children's skin color was becoming darker due to radiation. In a separate episode, the mother allegedly told school officials the FBI was after the boys.

While the city is contending Ogunbayo suffered from hallucinations (where would they ever get that idea?) and in addition was an absent mother , a separate legal case last month ruled in favor of Ogunbayo with the court stating no substantial evidence indicating the children were ever in "imminent danger" while in their mother's care.

The Staten Island Advance reports that in fact, the two children had near-perfect school attendance and were "even thriving academically."

However, the mother claims that the ACS has yet to return her children to her care. See video;

Boy, she is really serious with that dollar amount? If she is, I really think she might be mentally unstable with that way of thinking. No one can get that amount of money at all. She may have a good case of the ACS doing wrong toward her, but her asking amount is much like that jerk of a DC lawyer who asked for millions of dollars from a dry cleaner over a pair of pants.

I doubt this will scare them. That DC lawyer guy *lost* his case and ended up with *nothing*. Just like the DC guy, this woman is representing herself, and anyone knows that if you represent yourself, you're more likely to loose. It's like a doctor trying to operate on himself. Not going to work. If she was truly smart, she would get a lawyer and aim for a reasonable 'first bid' amount, say 100 million, so she could end up with least 10 million or bit more.

You know why she's acting as her own lawyer? Because she couldn't find one to take the case. If by some miracle she wins, she will get such a tiny award that it will be laughable. No lawyer would take the case on the chance that their fees would never be covered.

I don't think it's the fees. A lawyer will probably (and should) get disbarred and sanctioned for signing papers requesting that relief.

This suit is NEVER going to make it past the inevitable motion to dismiss.

It's litigation claims of that magnitude that makes American litigation the laughing stock of the common law world. Many countries put realistic caps on amounts that can be recovered. If such wild amounts could be recovered can you even imagine what your liability insurance premiums would be?

I've seen some pretty wild jury awards. I don't know if the "Stella Awards" are fiction or fact:

but the McDonald's hot coffee case is definitely fact. In it the Jury awarded 2.7 million dollars to a woman who spilled coffee on herself to punish McDonald's due to its coffee being so hot, but a Judge reduced that jury award to $480,000 (the reduction was rarely reported to maintain the sensationalism of the jury award).

      Just looking at some of the claims like the FBI is after her kids, I think that proved it before this case. This just cinches it. If she just "lost it" one day and hurt one of those kids because their skin was getting darker, people would have been upset because nobody stepped in to help.

      I recall a wonderful institution that closed that would have gladly taken her for rest and relaxation that she would have been a prime candidate for. It's name was Willowbrook and she would have done extremely well there and gotten the treatment she so desperately needs.

      She may be really bad at math - or really pissed off that this happened to her family. Or she was really smart enough to know that the amount would be picked up by the media and she could get her story out there.

      Kids thriving, doing well academically, healthy, and throw in regular weight for good measure - what could she possibly have been doing wrong? She's probably a little quirky, but if every parent with quirks had their kids taken away - no one would be parenting their children and quite frankly, most foster parents wouldn't qualify, either.

      When I hear about a case like this, I can't help but think of the novel QB V11 where the jury agreed that the plaintiff should win the case, but awarded damages of "one half penny, the smallest coin of the realm".

      While everyone wants to focus on the money she is asking for which we all know is absurd, the real issue is the practice by ACS of stealing kids from their parents. Countless good parents throughout New york and across the country find themselves in the same situation. Their kids are taken away for bogus reasons and the parents often don't have the financial and other resources to fight the city in court. I did research on this topic years ago. The situation is horrific and something must be done. Only a small percentage of the kids taken involved physical abuse and studies show that there in more abuse in foster care homes than with the natural parents. The foster care system can only stay in business if new bodies are constantly brought in which means that there is an economic incentive behind the kidnapping of children.

      I am glad that this woman asked for $900 trillion because it at least draws some media attention to the atrocities committed by ACS.

      She may not have been hitting them or starving them but she was seeing things and wouldn't get help. taking the kids away was the right thing to do here. Physical abuse should be the only reason for kids to get placed in another home. Having a bat @!$%# crazy parent is a pretty good reason too.

      lastone: The kids were healthy, doing well in school and from what I read were not in any danger. Since when is ACS responsible for psychology evaluations of parents? Parents who smoke need to have their heads examined because they are slowly killing themselves and those around them, yet ACS is not stealing kids from parents who smoke. ACS should be abolished because the only thing it protects are the profits of the institutions raking in money from the kidnapping of children who are mostly Black and Latino.

        That is a really ridicules comment.

        What "institutions" would you be referring to curtis? It is a common practice on this forum for people to provide references or links to back up their comments. Perhaps you would care to provide us with a credible reference to back up that ridicules contention.

        What difference does it make if a kidnapped child is Black or Latino? Do those children and their families suffer less when they are kidnapped or abducted? Or is it that you think Black and Latiino children are less important than White children?

        Jerry I am the last person you want to ask for references. I wrote a booklet on the topic years ago entitled: The Child Abuse/Neglect Resource Guide. It is filled with references. I worked with parent groups, organized forums, done radio shows and newspaper interviews on this subject. I can provide you with links, but I doubt that you are willing to read through the massive volume of material on children wrongfully taken from their parents by child protective services.

        A disproportionate percentage of children in foster care are Black and Latino. That is an objective fact. Feel free to draw whatever conclusions you wish as to why that is so.

            That's wonderful, but how was anyone supposed to know that?

            As far as a "detailed analysis" is concerned, I am not going to wade through all that information right now, because I do not need to be convinced that CPS agencies have a tendency to overreact. I am aware there are way too many horror stories regarding children being wrongly taken form their parents by CPS agencies. However, I have bookmarked, and intend to read all of it when I will have time to digest it properly.

            As someone said elsewhere in this thread, CPS has a very delicate balancing act to perform. They are constantly in a "damned if they do" and "damned if they don't" situation.

            However, all that being said, and all the links you have provided do not answer my questions which are, what are the institutions that are supposed to be "raking in money from the kidnapping of children"?

            and,

            I know a disproportiornate number of children in foster care are Black and Latino, and I understand why that is. However, you referred to kidnapped children, not children placed in foster care. If your referring to them as one in the same, then you need to say that.

            Actually I believe we are on the same page here, it's just a matter of the way you have worded your comments that has caused some misunderstanding.

                I have gone thru one apeal and now am on my second. I am apealing all the way to the state capitol of Tx to clear my husband and my names. CPS has closed its case, but found us “Reason To Believe” on Medical abuse & neglect of our youngest who is soon to be 5 years old. All because a dentist got her panties in a wad, because I decided I did not want her surgically working on my child’s teeth in the hospital. I found out that an 18 month old had died, from being overmedicated with morphine at the same surgery center, where they used the same anesthisiologist. When I found this out, I decided I was not going to allow my baby to be the next victim. After I was nice enough to call and cancel the appt, the dentist representative contd to call and harass me. They even called my family members out of town, trying to hunt me down. Telling them that it was urgent I called them back, “OR ELSE.” I figured why call again, I already called them once and told them I was cancelling and taking my child to another. The night of the cancelled appt, the police showed up at my door at 11pm. They claimed they got a call, stating my youngest child was being starved to death and was near death. They came in my home and asked that i wake my child up so they can investigate themselves. I did as asked. They said they found nothing wrong and will put in the report, that they found a happy & healthy child. CPS Caseworker came by the following day. Told us she got an, “anonymous call” that my child was “starving to death.” She interviewed everybody and demanded I get her tested to find out why she is petite and demanded I get all her teeth, surgically done. I told her not all her teeth were bad, that she just had 1 sore tooth. She said get them all done or else. So, on thier orders a denist did a 4 hr surgery on her, giving her root canals on all 10 of her baby teeth. Whether she needed it or not. My baby’s face was disfigured afterwards and was in alot of pain. After all that, they closed the case still saying that we were guilty of medical abuse & neglect. I am fighting to clear our names. Still to no avail. This second apeal has been taking longer than a month already. The state said it will be quite longer and to be patient. Meanwhile, this dentist who started this all is still smelling like a sweet rose. I wish there was a way to get back at her for all the heartache she cause my family. But was told that Obama signed something into law, that protects medical professionals from retribution. So, they can file false claims and get away with it. I even commented on yellow pages about this dentist and they hired an atty, telling me to remove my post or face jail time. So I removed it right away. So people….my fight is not over. Even though I did not lose my children over this, I did lose my dignity and self esteem. I am afraid to go anywhere in public or tae my children anywhere. For fear of being reported for the slightest little thing, from my child getting a scraped knee from playing in the park, to who nows what else.

                  There are countless stories of abuse by Child Protective Agencies.

                  There sure are, ...... way too many of them.

                  Perhaps you should compile all your references and expand your pamphlet into a book on the issue.

                  You also could start a Newsvine group focused on CPS abuses.

                  I could do a book on it, but it is a very frustrating issue to deal with because most parents have no interest in the subject until their kids are taken. Most politicians and activists don't want to deal with it either. Also, listening to countless parents crying, pleading and desperate is hard to deal with. I'm working on another project and I am not ready to get back into that fight.

                    It's frustrating that's for sure, but much of that frustration is born out of the heart wrenching situations that are created by overzealous or incompetent CPS agencies.

                    It's a problem that needs much more attention, and a well written book, threaded with 2 or 3 sub-threads following the course the lives of foster children and their parents took after their homes were broken up by CPS ..... might just be the material for a best seller. Not to mention the potential resulting reforms in CPS that might be implemented.

                    Been there, done that! I have written several "save the world" books. That last one I spent three years on. It got great reviews and everyone who read it loved it, but sales were not impressive. People are more interested in the lives of actors and actresses than with serious topics like this. I have pretty much decided to get out of the save the world business because there is no money in it and a lot of hard work and frustration. You have no idea what it feels like to give a lecture on a topic that will literally save people's lives, but only 30 people show up or do a radio show and only a handful of people order the book afterwards. I already put may time in for the cause and I have moved on. Writing brief comments on Newsvine doesn't take much time and I feel like I am still doing something.

                    Well, I think that CYS gets overly-enthusiastic sometimes. People with mental illness are NOT automatically bad parents!

                    I'm not in favor of kids being removed from a home unless it is an absolute LAST resort. Having a mom who is a little "out there" can be FAR less damaging than having foster parents who really don't care, might be abusive etc.

                    The ultimate goal of CYS should be to get kids OUT of the system, NOT into it.

                    I'm not saying I support these agencies, in fact IMO they do more harm than good, but I also feel they never win. If the kids get molested or even killed by their parents the agencies are blamed for not acting, and if they do take the kids away from a suspected problem, they get blamed for that. I'm sure as hell glad it's not MY job.

                    Buzz: actually most kids are removed because of supposed neglect, not physical abuse. The definition is so broad and vague that almost anything can be called neglect. If a parent doesn't want their child vaccinated that can be deemed medical neglect and the child removed, even though the parent made an informed decision based on their research into the subject.
